Common Questions About International Family Law

At Laura Dale & Associates, P.C., we are passionate advocates for families and children in Texas and beyond. Our attorneys have a tremendous track record of resolving international custody and child abduction cases and can be relied upon to guide you through every step of the legal process.

Which laws govern international custody and abduction cases?

These cases are often resolved under The Hague Convention of 25 October 1980 on the Civil Aspects of International Child Abduction, a treaty that provides a process for returning wrongfully removed and/or retained children to their country of habitual residence. Our firm has a long history and extensive experience in international child abduction cases and cases brought under the Hague Convention. There are other remedies available under the Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) and the Parental Kidnapping Prevention Act (PKPA). There is no substitution for experience when your children have been abducted.

What can the Hague Convention do for me and my child?

The treaty is critical in helping a "left-behind-parent" secure the prompt return of a child to his or her country of habitual residence and to restoring the status quo. In addition, the treaty can be used to provide access to a child when access is being denied by the parent who is in possession of the child.
