NBA star wins court battle over child support

On Behalf of | Dec 14, 2012 | Child Support

Deciding to have a child is a big decision for couples, but when the relationship fails, the couple will still need to go through child custody and child support issues. It doesn’t matter if you are a sports celebrity or not, these real life issues can affect everyone. This is the case for NBA star Chris Bosh who has been dealing with a child support battle with his ex-girlfriend over child support for their daughter.

The ex-couple were back in court because his ex-girlfriend claimed that Bosh’s primary residence was in Miami, Florida, not Texas. Her attorney revealed in court that Bosh’s name had been taken off the Texas voting lists and that he owns a Miami Beach home. Bosh and his attorney were able to defend his claim that he does live in Texas, avoiding a $30K a month child support payment.

The judge in the case based his ruling on Bosh’s residency because his income tax filings were filed in Texas.

Bosh claims that in 2010 he gave his ex $250,000 and pays for his child’s medical and dental insurance, which wasn’t required by the court. He also pays for all preschool expenses, extracurricular activities and has set up a college fund for his daughter.

Child support issues can be contentious especially if you are a high net worth individual. In Texas, an attorney can review your case and determine if the Texas Child Support Guideline payment meets the needs of your children. An attorney will look at all factors to determine if you have a case for lowering the amount of support. In the end, it is the court’s discretion to raise or lower the amount of payment. The judge will make sure that whatever figure is agreed upon is in the best interest of the children.

In Bosh’s case the judge ruled that according to Texas law, Bosh is paying what the courts deem necessary and no increases in child support are necessary for the welfare of his child.
